TERMS AND CONDITIONS
of using www.supermarket.am
GENERAL PROVISIONS
These Terms (hereinafter referred to as the "Terms" or “Agreement”) govern the legal aspects related to the provision of online services through the www.supermarket.am website (hereinafter referred to as the "Website").
Website is an online store, which is owned, operated and, consequently, the services are provided by “LEVAN GROUP” Limited Liability Company (hereinafter referred to as “Company”).
This Terms are an offer to join the agreement. By accessing the Website և and/or using any service provided through the Website, by making any purchase through the Website, or by downloading any material (in whole or in part) (any of which is hereinafter referred to as "Service" and the user of the Service or the visitor of the Website is hereinafter referred to as "User"), the User confirms that he/she has read, understood this Terms in its entirety, has agreed to it (accepted this offer to join the agreement) without any reservation, regardless of whether the User has actually used the Services, registered on the Website or simply visited the Website. If the User does not agree with the terms set forth in this Terms, he/she is not entitled to use the Services.
By consenting to this Terms, User acknowledges that he/she has a full legal capacity under the laws of his/her country and has the right to use the Services, otherwise to use the Services User shall get the consent of his/her custodian/guardian.
The person registering on the Website on behalf of the legal entity and/or using the Services certifies that he/she has all the authority given by the legal entity to act on behalf of the legal entity and conclude transactions.
The company is in no way obliged to check the User's authority (the right to conclude transactions on behalf of a legal entity). The full responsibility for that lies on the User.
USING THE WEBITE
User is free to visit the Website without registering, but to use the full range of Services, as well as to take advantage of the wider possibilities provided by the Website, it is necessary to register on the Website by opening a user Account (hereinafter referred to as "Account"). Each User can have only one Account. Users are not allowed to use another User’s account. When opening an Account, User is required to accurately fill in the information required to open an Account. User is responsible for the accuracy and reliability of the data entered by him/her.
ONLINE SUPERMARKET
An online supermarket is an electronic shopping platform that allows the consumers to find the product they need, make an online payment and request delivery to the address specified. The website, with photos, search capabilities, provides the visitor with complete information needed to make a purchase.
The Company provides products "as is" and without warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. The Company does not warrant that the products will be error-free, or that any defects will be corrected. The Company does not make any representations or warranties regarding the use or the results of the use of the products in terms of their correctness, accuracy, reliability, or otherwise. The Company does not warrant that product descriptions or other content of the website are accurate, complete, reliable, current, or error-free.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall the Company’s total liability to the customer for all damages, losses, and causes of action (whether in contract, tort, including negligence, or otherwise) exceed the amount paid by the customer, if any, for the product giving rise to the liability.
Customers are responsible for ensuring that they have the correct information regarding their allergies, intolerances, or other dietary restrictions before consuming any products purchased from the Company. The Company shall not be held liable for any adverse reactions due to ingredients or components of the products sold.
PRICE OF SERVICES
The prices of the products are published on the Website. In order to make payments for the products, User needs use either Debit Card, Credit Card, other means of payment if accepted by the Website, or pay by Debit Card, Credit Card or cash during the delivery.
The Company reserves the right to change the prices of the products at any time by posting updated prices on the website.
The User hereby acknowledges and agrees that in case of disclosure of unauthorized transactions made by the User with payment cards or other means of payment belonging to others, where the owner of used means of payment in any way got a refund from the Company, the latter reserves the right to demand from the User the full value of the product(s) and a penalty in the amount of up to 100% (one hundred percent) of the value of the product(s), as well as full compensation for the damages caused to the Company.
In case of a possibility to receive bonuses, the Company reserves the right to cancel the accumulated and unused bonuses of the User, if the latter does not use make purchases from the Company's website for 3 /three/ months or longer.
THE CONTENT OF THE WEBSITE
The content, structure, design of the Website and any other Website-related factor (hereinafter referred to as the “Content”) is protected with its owner’s exclusive right of ownership and respective copyrights. Except sharing the links of the Website or its pages it is strictly forbidden to in any way print, distribute, use or publish any Content of the Website.
The names, trademarks, products, services, articles, photographs, images, graphics, audio and video materials, software of third parties, or hyperlinks to other websites and any other information posted on the Website are only for the convenience of the User and in no way imply Company’s confirmation, acceptance, sponsorship or offer (oferta) of the completeness and/or truthfulness of the information about such third parties or their products or services. The Company is not responsible for the content of the mentioned websites and materials and does not confirm their authenticity. The User acknowledges and confirms that in case of following the links of the mentioned third party websites, he/she visits those websites on his/her own initiative.
The Company is not responsible for any services and products offered or rendered by third parties through the Website.
The Company is not responsible for the quality, malfunction, incompleteness of the products/services purchased through it or with its help from third party websites.
The User acknowledges and agrees that any rating, comment or suggestion made by him/her about the Website, the Products, or the Services will be provided in its entirety on a voluntary basis based on the User's personal experience on the Website. The Company reserves the right to use these ratings, comments or suggestions without the prior consent of the User, without any obligation to the User in connection therewith. The Company reserves the right to maintain or delete/remove the ratings, comments or suggestions provided by the User on the Website, as well as any other data, information, materials or content provided/completed by the User.
MEAT RETURN POLICY
Meat products cannot be returned once they have been delivered to the address you provided. please check the quality and suitability of your order carefully upon delivery.
CHANGES TO THIS TERMS
Company reserves the right to unilaterally modify this Terms at any time without prior notice to User by simply posting the latest revised version of the Terms on the Website, indicating the date of the last change/update of the Terms. It is the User's responsibility to visit the Website from time to time to check for changes of the Terms. Changes take effect and apply to all Users (including those registered on the Website, or/and those not registered on the Website or/and those who use the services provided by the Company prior to the publication of the new Terms) from the time they are posted on the Website.
In case of disagreement with the new Terms, User has the right to terminate the use of the Services, otherwise, by continuing to visit the Website and/or use the Services, User gives his/her unconditional consent to the new Terms and may not submit any claim or complaint to the Company with regards to the new Terms.
TERMINATION OF THIS AGREEMENT
The User has the right to terminate this Agreement at any time in case he/she fulfills all his/her obligations towards the Company as of the date of termination, including the payment obligations.
In order to Terminate this Agreement and close the User Account, User shall send an application to the Company at support@supermarket.am from his/her e-mail address specified in his/her Account as of the date of sending the application, by indicating his/her e-mail address provided during Account registration.
The Company reserves the right to unilaterally terminate this Agreement if the User disseminates untrue information about the Company or the Services provided by the Company, with his/her actions tries to form a negative opinion about the Company or in any other case when the Company finds that the User's actions does or may damage the Company's business reputation. In case of termination of this Agreement on any of the grounds provided for in this paragraph, all bonuses of the User (if such bonuses are provided) shall be canceled, and the amounts already paid by the User for the Services shall not be refundable to the latter.
The Company reserves the right at any time, for any reason, to unilaterally refuse to sell any products or provide all or part of the Services to the User and/or unilaterally terminate this Agreement. In case of termination of this Agreement or Services on any grounds other than those provided for in the preceding paragraph, the cost of the paid but not provided Services shall be refunded to the User.
DISPUTE RESOLUTION AND APPLICABLE LEGISLATION
The RA legislation is applied to this Terms.
Any dispute arising in connection with this Terms shall be settled by negotiation, and in case of disagreement, by the competent court of the Republic of Armenia in accordance with the procedures established by the legislation of the Republic of Armenia.
